Terms of service

These terms are between you and Business Boat (GSTIN 08DOEPK7742L1ZF), Mahalakshmi Dairy, Hathinada, Kankroli, Rajsamand, Rajasthan 313324, India. They apply to anyone who uses thebusinessboat.in or Business Boat's software and services, including our CRM, team inbox, chatbots and WhatsApp Business Platform integration ("the services"). By using the services you agree to these terms.

The services

Business Boat provides software and technology services to businesses, including connecting WhatsApp Business numbers to the WhatsApp Business Platform, building chatbots, CRMs, custom apps and e-commerce stores, and IT, hosting and support. The scope, price and timelines for each project are agreed in a separate quote or agreement.

Your account

• You must give accurate details and keep your login secure.
• You are responsible for everything done under your account by you and the team members you add.
• You must be authorised to act for the business whose WhatsApp, Facebook or Instagram accounts you connect.

WhatsApp and Meta

• When you connect WhatsApp, you also accept the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy and Commerce Policy.
• You must message only people who have agreed to hear from you, and honour any request to stop.
• Your WhatsApp Business account, phone number and message history stay yours. You can disconnect our app at any time.
• Meta charges for WhatsApp conversations according to its pricing. These charges are billed to the payment method on your own WhatsApp Business account unless we agree otherwise in writing.
• Meta may approve or reject templates, limit messaging or suspend accounts under its own policies. We are not responsible for Meta's decisions, but we will help you resolve them.

Acceptable use

You must not use the services to send spam, unlawful, misleading or harmful content, to sell goods banned by WhatsApp's Commerce Policy, to break the law, or to try to access other clients' data or disrupt our systems.

Fees and payment

Fees are set out in your quote or plan. Invoices are payable within the period stated on them. We may pause services if invoices remain unpaid after reminder.

Your data

You own the data you put into the services. We process it only to provide the services, as described in our privacy policy. When you leave, you can ask for an export of your data before we delete it.

Our work

Unless agreed otherwise, custom work we build for you becomes yours once paid for in full. We keep ownership of our own tools, libraries and platforms that we use across clients.

Availability and liability

We work to keep the services available and secure, but cannot promise they will be uninterrupted, as they depend on third parties such as Meta and hosting providers. To the extent the law allows, our total liability for any claim is limited to the fees you paid us in the three months before the claim, and we are not liable for indirect losses such as lost profits.

Ending the services

You can stop using the services at any time by telling us. We may suspend or end the services if you break these terms or Meta's policies. Sections about fees, data, liability and law continue after the services end.

Law

These terms are governed by the laws of India, and the courts at Rajsamand, Rajasthan have jurisdiction.
